1. AGREEMENT TO TERMS

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Kissnthrill OÜ ("Company," “we," “us," or “our”), concerning your access to and use of the website www.kissnthrill.com as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

Kissnthrill OÜ is a registered company in Estonia (Registration Number: 17358125) with its registered office at Kaluri tee 4-4, Haabneeme, Viimsi vald, 74001.

You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

2. PRODUCTS AND BILLING

  • Purchases: We offer swimwear and apparel for sale. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site.
  • Pricing: All prices are subject to change. Prices are generally displayed in Euros (€) and include VAT where applicable.
  • Payment: You agree to pay all charges at the prices then in effect for your purchases and any applicable shipping fees. We authorize our payment processors (Shopify pay, Stripe and PayPal) to charge your chosen payment provider upon placement of your order.
  • Order Refusal: We reserve the right to refuse any order placed through the Site.

3. SHIPPING AND RETURNS

For detailed information regarding our shipping timelines and return procedures, please refer to our dedicated Shipping Policy and Refund Policy, which are incorporated into these Terms by reference. In accordance with EU law, customers have a 14-day right of withdrawal for most items, provided they are returned in original, unworn condition with hygiene liners intact.

4. INTELLECTUAL PROPERTY RIGHTS

Unless otherwise indicated, the Site is our proprietary property. All source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the “Content”) and the trademarks and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us. No part of the Site and no Content or Marks may be copied, reproduced, or exploited for any commercial purpose whatsoever without our express prior written permission.

5. USER REPRESENTATIONS

By using the Site, you represent and warrant that:

  1. You have the legal capacity and agree to comply with these Terms.
  2. You are not a minor in the jurisdiction in which you reside (at least 18 years of age).
  3. You will not access the Site through automated or non-human means (bots, scripts, etc.).
  4. Your use of the Site will not violate any applicable law or regulation.

6. PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than that for which we make the Site available. Prohibited activities include, but are not limited to:

  • Systematically retrieving data to create a database or directory.
  • Circumventing, disabling, or interfering with security-related features.
  • Engaging in unauthorized framing or linking to the Site.
  • Using the Site to advertise or offer to sell goods and services without authorization.
  • Uploading or transmitting viruses or malicious code.

9. GOVERNING LAW

These conditions are governed by and interpreted following the laws of Estonia. The use of the United Nations Convention of Contracts for the International Sale of Goods is expressly excluded. If you are a consumer residing in the European Union, you also possess the protection provided to you by the obligatory provisions of the law of your country of residence.

10. DISPUTE RESOLUTION

In the event of a dispute, we encourage you to contact us directly at support@kissnthrill.com to reach an amicable solution. If a resolution cannot be reached:

  • EU Residents: You may use the European Commission’s Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
  • Jurisdiction: Both parties agree to submit to the non-exclusive jurisdiction of the courts of Tallinn, Estonia, or the courts of your place of residence in the EU.

11. LIMITATIONS OF LIABILITY

In no event will Kissnthrill OÜ or our directors be liable to you or any third party for any direct, indirect, or consequential damages arising from your use of the site. Our liability to you for any cause whatsoever will at all times be limited to the amount paid, if any, by you to us during the six (6) month period prior to any cause of action arising.

  • Promoter: Kissnthrill (@kissnthrill).
  • Prize: Store credit or swimwear as specified in the promotion.
  • Eligibility: Entrants must be 16+ years old.
  • Selection: Winners are selected at random via a random number generator.
  • General: Prizes are non-transferable and no cash alternative is available. We reserve the right to modify or cancel giveaways in the event of unforeseen circumstances.
